Fiction: Advisory Committee Meetings Are Closed to Other Homeowners

FACTS:

Advisory Committees are open to homeowners.

Advisory Committee meetings take place in the Coachella Room in the HOA Building. This is a conference room with seating for 10. There are between 5-7 members on any given Advisory Committee, the Board liaison is required to attend, the General Manager also is required to attend and sometimes additional staff are needed to attend.  This means that at any point in time there are between 7-10 people attending a meeting which seats 10.

If any homeowner, at any time has a concern or suggestion for any one of our committees, they can contact either Hot-topics or the Chair of the Committee and ask to address the committee. Many homeowners have.

Agi Kessler’s Continued Fiction About Our Financials

February 14, 2018 – Agi Kessler posted again that our community had a $1.04 million loss in 2015. This post was on NextDoor. The previous post was on Facebook.

That is false. Here are the facts:

After nearly two years on our Board, Agi Kessler still does not understand our financials. She is still posting that we had a $1.04 million loss in 2015.

First, Sun City Shadow Hills Homeowners Association is a non-profit corporation. We do not have profit and losses, we have deficits and surpluses.

Second, during Agi’s 2016 campaign and again today, 2.14.18, Agi stated we had a $1.04 million loss in 2015.

Bottom line, we had no million-dollar deficit in 2015, and the 2015 Annual Audited Combined Financial Statement shows the $577,630 surplus on page 4.

As a Board member, the April 2016 Board Meeting Committee Notes show clearly that Agi signed off on this 2015 Annual Audited Combined Financial Statement.

Perhaps she did not read the 2015 Annual Audited Financial Statement before signing off on them or simply does not understand financial statements.

Either way, Agi Kessler’s continued misstatements regarding this matter are unconscionable and lead to several conclusions:

  • She lacks the financial skills that she claims to have.
  • She shows a continued lack of understanding, discretion & good judgment by continuing to post financial information which is untrue.
  • This is misinformation being spread by a sitting Board member, which divides our community.

FICTION: CHOSH Didn’t Vet all Candidates Before Endorsing Mostow, Marley and Stephens

Facts: We did vet all 5 candidates.

We spoke extensively with Voice Candidate Bob Israel. We learned his understanding of accounting, finances, financial analyses and California law.  We knew that his primary residence is Washington State, he is a snowbird; that he serves on a 20 unit condo Board in Washington State, which is professionally managed and the dues are $550.00 month with no amenities.  Bob was no doubt an excellent and successful Washington State insurance trial attorney, but our HOA Board members cannot rely on the advice of homeowner attorneys; particularly those from out of state who did not specialize in CA HOA law.

Agi Kessler:

We asked repeatedly to speak with Voice Candidate Agi Kessler, but on each occasion she has refused. Nevertheless, we have observed her behavior while on the Board. We noted she often took credit for the work of others. Had issues with liaison committee assignments. We checked her self-stated business background extensively.

After this vetting process, we elected to endorse those candidates who had the best qualifications and integrity to serve on our $25 million Corporate Association Board.

FICTION: SCSH Residents Who Didn’t Attend the Arraignment for Larrach, Don’t Care About SCSH
 On January 29, 2018, an eblast was sent out to residents with the following:

“You claim to be “Concerned Homeowners.” Does your concern extend to attending an arraignment hearing for the accused? We urge you to attend and offer you the information known to the Board majority and withheld from you” (*Note: They are referring to an arraignment in a criminal case against Ceasar Larrach)

FACTS: We were aware of the arraignment and this is a criminal case in which the Association is listed as a “victim.” Individual homeowners have no standing. It is up to our criminal justice system to handle this and see that justice is done. Our Association (homeowners) will have suffered no loss as Ceasar was bonded by Associa (thank God we are professionally managed)

We also believed that making a spectacle at the courtroom would draw unwanted negative press for our community – which it did when Mike Bard provided the “Desert Sun” with his quote:

“To be frank with you, I’ve told people that if this continues, I’m going to move.” Mike Bard, 78, SCSH part time resident.

Mike Bard is a long time Voice supporter, a good friend of Bob Israel, a supporter of Agi and Bob in this election and we believe his wife serves on our SCSH Nominating Committee.

Fiction: Canadians Cannot Vote in our Sun City Shadow Hills HOA Election

Fiction: Canadians Cannot Vote in our Sun City Shadow Hills HOA Election

Fiction: Canadians are being told they cannot vote in our SCSH Elections and must turn over a proxy to a full time resident.

FACT: All homeowners in Sun City Shadow Hills, (including Canadians and other snowbirds are eligible), and should vote in the SCSH HOA election in order to protect our property values.

If someone in our community convinced you to give them your proxy,, you can invalidate that proxy by requesting a replacement ballot at HOA Elections:

You will need to give them you live in Sun City Shadow Hills in Indio, CA –  your name and your SCSH address.

They will send a replacement ballot to you.

They must receive your ballot by mail by March 2 and noon or you may drop off your ballot at the Montecito Ballroom on March 5th between 8-10AM.
