SCSH Documents that Govern All of Us – What You Should Know

Cities, states and governments have laws to protect citizens.

Our SCSH HOA corporation has governing documents. Upon purchasing a home here, each of you received copies of the SCSH governing documents, including the CC&Rs and By-Laws and agreed to abide by them.

The developer of our community, Pulte/Del Webb, wrote the original documents which govern our community. Until they left our community, we were not permitted to change them. Now that they are gone, we can.

This is your opportunity, the first opportunity for all people who own here, to vote on how we want to be governed, subject of course to local and state law.

On April 19, the Board mailed or had mailed — the following two items to all homeowners:

1. A copy of the governing documents on a “flash (or sometimes called a thumb) drive with the proposed changes. If you did not receive this thumb drive or would prefer the document sent via email or would like a hard copy, email [email protected] for the best format for you.

2. A ballot from HOA Elections Company which homeowners will use to vote on the items presented.

It is important that you vote. If you don’t, other homeowners will be making these rules with no say from you. And, according to California State Law,  51% of all homeowners in good standing must vote yes or no on any of the 4 rules, or another vote will have to held — and another vote will cost us all money.

4 Rule Changes to the Governing Documents SCSH Members Are Voting On

Here are the 4 rule changes that the Board has presented to residents for a vote:

  1. Remove all references to Pulte (the original developer), in the document, except where it is in the best legal advantage to keep the reference in.
  2. Remover term limits from Advisory Committee Membership
  3. Get rid of undemocratic cumulative voting – in which a candidate with the support of just 500 homeowners can actually garner 1500 votes and defeat a candidate with the support of 1499 households.
  4. Do not allow homeowners to rent their homes for a day or a weekend. While the current governing documents restrict rentals to 90 days and over, there is a loophole which has allowed some homeowners rent their property out for a week, weekend or even a day. The compromise was to remove the loophole but reduce the minimum rental period to 45 days.

Voting on the SCSH Revised Governing Documents: Where To Request A Replacement Ballot

On April 19, information about and ballots to vote on 4 changes to our Governing Documents were mailed to homeowners via snail mail.

If you haven’t received your SCSH HOA election ballot yet, chances are, you won’t. But you can still vote by requesting a replacement ballot.

Please vote! How we are governed is up to us — and will be determined by those homeowners who vote.

4 Things the SCSH HOA Board Changed in the 2019 Election Process.

At the 5.21.18 Board meeting, our Board made some much needed change to our Election process:

1. Election Time Frame: The Election Time Frame will be moved back 1 month. Campaigning will begin February 1 and end in April.

*Hopefully this will allow for some peace and quiet during the holidays.

2. More HOA Community Candidate Forums:  In the 2019 Election, the Board has decided to hold

a. 2 Community Candidate Forums

b. 2 Meet and Greet the Candidate Forums.

*HOA Candidates Forums are the best way to learn about the candidates and our HOA. We are aware that politicians have found door to door canvassing to be the most effective method of getting votes. But the problems is, you aren’t really getting a true picture of the candidate or what they actually know by just having them show up at your door.

3. Signage Alternatives: Candidates will now be offered one of two ways to display their campaign signs

  1. A set number of candidate signs in prime common area locations. All candidates will be offered the same sites and the same number, or
  2. A candidate may continue to ask homeowners to display signs for them. There would be no limit on the number.

The caveat is, that homeowners at their own cost and discretion, may each display signage they have purchased. If their candidate has opted for the common area locations, their supporters signs cannot be the same as the candidates signs.

Erica Hedlund mentioned that name recognition was important in getting elected. And this, unfortunately is true. But we would prefer that homeowners not vote by name recognition – but on the basis of factual information – hearing the candidates and asking them questions. As we all know, most of the hardest and most effective workers are rarely known by name.

We would have preferred to see the candidates agree collectively to a limited number of signs in the common areas only.  Our elections are about electing members to our $25 million Corporate Board – not a political race. As Bob Israel mentioned, signage cost money – and we think all candidates should have equal exposure regardless of how much money they have to spend.

4. Increase in community media usage: In addition to the candidates’ biography which is printed in the View and the SCSH Community News Digital Website (www.scshca.com), Bob Firring will interview candidates for podcasts which will be available to all residents via the website, and all bios on the Info TVs.

We are hopeful that these changes will make the process easier for the homeowners to be informed voters.

Sir Laffs-A-Lot is BACK!

At the 5.21.18 Board meeting, President Kim Fuller announced that Sir Laffs-A-Lot is BACK!

We are so happy to hear this as it is one of the most, if not the most popular entertainment venue in our community.

Thank you to the President of the “That’s Entertainment Club,” Julie Johnston, for working with the board in a professional manner to see that this tremendous club event will continue.
